serving in the KY General Assembly.

KYR is a tireless advocate for our members and their clients. We believe everyone should be able to own property, free from burdensome taxes and regulations, in a healthy and sustainable community. That’s why KYR’s advocacy efforts focus on these critical areas; protecting homeownership, growing the economy, developing our communities, competing as an industry, and protecting private property rights. KYRs advocacy is supported by RPAC, the Kentucky REALTORS® Political Action Committee, which helps us to foster strong relationships with elected officials, policy experts, and governmental agencies to ensure that KYR has a seat at the table.

HB 521 – Strengthening Stalking Laws, sponsored by Rep. Steven Rudy: SUPPORT
  • Kentucky has long recognized stalking as a pattern of intrusive behavior that creates serious harm, but the structure of the law has not kept pace with how stalking occurs in the real world. HB 521 clarifies the elements of stalking while maintaining strong safeguards and clear thresholds for harm and expands coverage to reflect modern stalking behaviors, including technology-facilitated conduct such as electronic and online communications, surveillance, AI-enabled contact that bypasses efforts to block communication, and other forms of unwanted intrusion.

  • Stalking in the real estate industry is a serious safety concern, with agents—particularly women—frequently targeted by offenders posing as customers or potential clients. Instances range from cyber-stalking and threatening phone calls to physical stalking.

  • For many, a simple inquiry can escalate into repeated unwanted contact, surveillance, or threats that extend beyond the workplace and into their personal lives. That risk is why KY REALTORS® strongly support strengthening Kentucky’s stalking laws: not only to better protect those in the profession, but to ensure clearer, faster intervention for all Kentuckians before stalking behavior turns into violence. Stronger laws mean stronger tools for law enforcement, greater accountability for offenders, and safer communities where no one has to wait for harm to occur before the system can act.
HB264 – Deed Fraud, sponsored by Rep. Marianne Proctor: SUPPORT
  • HB 264 would amend KRS 514.040 to establish that a person is guilty of theft by deception when the person lists or advertises residential or commercial property for sale, lease or rent without legal title or the authority to do so.
HB 411 – Increase Real Estate Transaction Fees/AHTF, sponsored by Rep. Steve Bratcher: OPPOSE
  • HB 411 proposes to increase real estate transaction fees and index those fees to inflation (CPI-U) automatically beginning January 1, 2027 and every year after. Revenue generated from the fee increases would support the Affordable Housing Trust Fund. Who pays the increased fees? Kentuckians who have made the financial decision to purchase their own home.· While we appreciate the proponent’s well intended efforts to identify ways to increase affordable housing options, the proposed funding mechanism included in HB 411 will place additional financial burden on homebuyers, particularly at the time of closing. While the topic of housing affordability has been front and center in Kentucky and across the nation for the past few years, we do not believe that increasing fees on homebuyers is the right solution.
SUPPORT HOUSING REFORMS TO BUILD A STRONGER KENTUCKY
  • Regulations & Process: Avoid costly regulations and streamline approval processes: Lawmakers ought to avoid policies that increase costs for home builders and buyers. Even small regulatory changes and new fees can compound to raise final home prices.

  • Support Residential Infrastructure: Establish a low-interest state revolving loan fund to provide financing options to local governments for residential infrastructure and develop other tools such as “infrastructure development districts” or “housing development districts” that provide local governments alternative ways to finance residential infrastructure.

  • Incentivize Local Land-Use Reform: Kentucky’s local land-use policies need to be modernized at the local level to help make housing and home ownership more attainable for working families. Locally-implemented reforms should include greater flexibility on minimum lot sizes, parking limitations, and setback requirements.· Support Affordable and Workforce Housing: The state ought to strengthen public-private partnerships by offering effective tax credit programs that leverage private investment to expand and incentivize development in communities demonstrating the greatest needs.
